1. The Service Agreement
All photography sessions are subject to a separate, signed Service Contract. While these website terms govern your use of this site, the specific details regarding your shoot (dates, times, deliverables) will be outlined in your individual contract. A booking is not confirmed until a retainer has been paid and a contract has been signed.

2. Intellectual Property & Copyright
All images, text, and designs on this website are the sole property of Emily Fell Photography.

Ownership: I retain the full copyright to all images produced.

Usage: When you purchase a package, you are granted a Personal Use License. This allows you to print and share your photos for non-commercial purposes.

Prohibitions: You may not sell my images to third parties, enter them into contests, or use them for commercial advertising without express written consent.

No Alterations: In alignment with my commitment to true-to-life artistry, you agree not to apply filters or significantly alter the final edited images provided to you.

3. Payments, Retainers, & Cancellations
Retainers: A non-refundable retainer is required to secure your date. This covers the loss of other potential bookings and my administrative time.

Payment Schedule: Final balances are due as outlined in your contract (typically [e.g., 2 weeks] prior to the event).

Cancellations: If you cancel your session, retainers are non-refundable. Rescheduling is subject to my availability and may incur a rescheduling fee.

4. Artistic Style & Client Expectations
By booking Emily Fell Photography, you acknowledge that you have reviewed my portfolio and are familiar with my "true-to-life" and editorial style.

I retain final artistic discretion regarding the editing and selection of images.

RAW Files: I do not, under any circumstances, release unedited or RAW files. My service includes the final, hand-edited gallery as the finished product.

5. Limit of Liability
While I take every precaution to protect your images, Emily Fell Photography is not liable for loss or damage to data due to equipment failure, theft, or "Acts of God." In the unlikely event of an emergency where I cannot perform the services, my liability is limited to the refund of all monies paid.

6. Governing Law
These terms are governed by the laws of the State of Minnesota. Any disputes arising from these terms or my services will be handled in the courts of [Insert County, e.g., Hennepin] County, MN.

7. Changes to Terms
I reserve the right to update these terms at any time. Your continued use of the website and my services constitutes acceptance of the updated terms.
